TERMS & CONDITIONS

The Terms & Conditions below apply to all customers placing orders with Phatphones.com:

1. Deliveries & Delivery Charges

  • Orders by Royal Mail standard post is subject to a charge of £3.95 and Courier or Special Delivery is £6.95 in UK and £18.00 for the rest of the world, unless it is a trade order.

  • All orders to the UK are sent out within 2-3 working days of payment reaching us unless the goods are out of stock, in which case we shall contact you, however most go out the next day after ordering.

  • For overseas orders allow up to14 days but some orders due to the postal services may take longer.

  • All deliveries by City Link require a signature upon delivery. If in the event that no one is home a card will be left. There are 5 days to arrange a re-delivery. After this period if no delivery is arranged or the parcel has not been collected the parcel will be returned to us. In such an instance if the courier prove the card was left then we will charge you for the return back to us which will be the shipping cost paid + £6.95 return to us and a redelivery would need to be arranged and paid for. If this this instance if you would prefer to cancel there will be a cancellation charge of 4% and the shipping will be non-refundable.

  • Don't select Courier shipping if you are not available to provide an address where it can be signed for or an alternative place to leave it if out.

  • If you have ordered and requested Special/City Link delivery and not received a card within 5 working days please call/email us as it may have been lost or thrown away with junk mail entering the house

  • At busy periods such as Christmas, orders may take a little longer, but we will ensure to get all orders out for pre Christmas delivery. To ensure you get a fast delivery & not dependent on Royal Mail at their busiest time, it is advised to select Special/City Link.

  • We cannot be held responsible for any delays in the Royal Mail Delivery Service or City Link.

  • If a parcel is lost in transit we allow 14 days before re-sending any item in UK and 35 days for overseas and longer to refund (as many do eventually turn up) so we would suggest the following:

    If you urgently need the item you can re-order it and pay courier shipping of £6.95 and it will be sent out by Special/courier again for you for next day delivery. Then if the original order turns up you can return it to us for a refund. Due to the high volume of orders not arriving on time by Royal Mail, many do actually arrive sometimes a few weeks later.

  • We will re-send an item lost by Royal Mail after we receive confirmation from you in writing that it was not received, this will be after the 14 day period has passed in the UK and 35 days for overseas.

  • You may be approached by Royal Mail regarding any item not received and will be obliged to explain the circumstances.

  • Refunds for items lost in the post will be dealt with after 1 month in case they do eventually arrive.

  • We do not deliver to Nigeria, Philippines, Malaysia, or related countries in the Far East and some parts of Asia & Africa.

  • We may not deliver to a different delivery address to that of cardholder, this would be done at our discretion & proofs of ID in some cases may be required.

  • We would certainly not deliver to another country to that of cardholder without further ID.

2. Refunds Policy & Returns

7 Day Money back Guarantee.

  • Refunds are given if the goods are unsuitable, unobtainable, faulty or damaged. An exchange will be offered &  if a replacement is not available then a credit voucher will be issued or a refund back to the card which was used to purchase the item(s). If for any reason you have received such an  item and you feel you need to return it to us, then send to the return address on the back of your parcel. Please note this must be within 7days (non-working days inc.) of receiving your order. Failure to do so will result in an exchange or credit note only being offered. We will offer exchange or a credit note up to 28 days from the purchase date.

  • If the goods are faulty or damaged on arrival, then we will credit you for return shipping, however if the goods are unsuitable or no longer required, you must pay shipping the goods back to us.

  • If the goods are faulty or damaged then we will refund the full transaction but if the items are no longer required or unsuitable then we will refund the transaction minus the shipping charge.

  • A cancellation charge will be taken for any item which was ordered that is cancelled which amounts to 5-7% of the sale price of the order, unless cancelled on the same day as the order was placed.

  • It  is the customers responsibility for the safe return of any item being sent back to us. Please send back any item by recorded or registered post. We will not be held responsible for any item lost on its way back to us.

  • Items sent back to us must include all original packaging, leaflets, booklets, instructions or inserts that were inside when you received it and in the condition it was received.

  • Nothing can be done without proof of purchase, so please keep receipts issued  & return original receipt, copies will not be accepted.

  • Any decision of action can only be taken on inspection of the product.

  • Replacement items can only be sent out on the return of the original item.

  • We will not exchange or refund goods that are willfully / accidentally damaged, repaired or modified.

  • If you buy a repair part to fix a fault on a phone and it is not fixable with that part due to further faults with the phone or further parts needed. We will take 15% off if returned as these parts are all new and once returned from being in a phone, it is no longer new.

  • All returns are down to our discretion.

  • We do not give refunds on deposits taken to secure any item on this site.

3. Stock Availability

  • Any item advertised on our web site should always be in stock, in the unlikely event  that we are out of stock of any item ordered, we shall contact you within 3 working days of the date the goods were ordered, to notify you of a likely delivery date or any other options. We may contact you by Email, Telephone or a Text message.

  • You may wait for stock to be replenished.

  • Take an alternative product and settle any price difference.

  • Get a Credit Note.

  • Get a refund.

4. Methods of Payment

We accept the following methods of payment :

  • Visa, Master Card, Switch, Delta & Solo securely on line. The amount payable is debited when we are certain the order will be processed,  not when the goods are despatched. We must complete our orders within five working days from the order date.

  • Personal Cheque/Postal Orders - Must be made payable to : 'Phatphones'
  • PayPal payment can be arranged, paid to elka@phatphones.com

5. Pricing

  • Unless otherwise stated, all our prices include VAT.

  • Prices can change instantly and with no advanced warning.

  • Prices may differ on our web site to the prices in our shop.

6. Warranties

  • All new products come with a years manufacturers warranty.

  • If  a fault develops on a new handset within 14 days of purchase, return it to us.

  • After 14 days if a fault develops on a new handset, it becomes the responsibility of the manufacturer and would need to be sent to a local service centre to repair. If it is sent back to us, the process would be much longer and costly as we have to pay a charge to give it for warranty repairs.

  • Reconditioned, second hand products come with a 2 month warranty and if for any reason a fault develops then return it to us for repair. If the fault found is due to damage by the customer, then a charge to repair will be enforced. Otherwise we will repair the phone free of charge.

  • Standard repair jobs carry a 2 month warranty.

  • Refurbished phones have a 4 month warranty

  • Accept liquid damage which has no warranty due to liquid ingress (This includes acts where by a phone is sent to us to repair and it comes back worse off due to the spread of liquid.)

  • Unlocking a PAYT phone may make the warranty no longer valid.

  • Changing the colour LEDs will make the warranty no longer valid.

7. Repairs & Customisation

  • Although we use technicians of the highest caliber, unfortunately because of the  delicate nature of the inside of a mobile phone, unavoidable damage can occur from time to time. Phatphones takes no responsibility for the damage to any phones sent to us for repair or customisation . If such an event ever occurs, we will do our utmost to come to a fair arrangement for you.

  • Phatphones can not be held responsible for unspecified damage to a phone sent in to us that has previously been opened by a non qualified technician as damage can be done at this time and go unnoticed. We will repair a fault a phone has come in for and test the phone. If another fault is picked up on and fixed, further charges may occur. If the fault is not fixable, Phatphones.com holds no responsibility for this.

  • Liquid ingress in a phone sent to us for repair holds no cover by phatphones.com if (the phone comes back in a worse off state than when first sent in. As liquid spreads with use and can affect different parts of the phone at any time especially with use. Liquid can rust the insides and stick parts of the phone together that should not be so. When we open the phone to repair it, it is sometimes unavoidable to damage these sticky parts as they come away. This is due to the length of time left between the liquid entering and the time of repair. We recommend that a phone should be sent off for repair as close to the point of liquid contact as possible and do not try to carry on using it as the damage will spread. This guide line should rule out the above situation.

  • Please note: We are not an authorized dealer repair center, however, any work undertaken is carried out by qualified technicians .

  • Repairs, customisation or modification can void manufacturer warranty.

  • Do not send us sim cards as we will not be held responsible for them.

  • Send the handset & battery only.

  • Send the phone by Special Delivery (registered post) where it is covered by insurance. We will not be held responsible for any phone sent by standard Royal Mail or recorded delivery which may have missing bits or been tampered with or damaged on it's way to us.

  • Always send details of IMEI, name address, job required and payment method with amount paid and price and date paid.

8. Unlocking

  • We unlock phones to work on other compatible networks. We do not change IMEI Numbers or handle stolen phones.

  • In some cases the phone sent may not be able to be unlocked. If this the case the charge for the unlock will be refunded but the shipping charge to return the phone will still stand.

  • Most phones are sent to us for unlocking. If an unlock is ordered & it was not noted that it has to be sent in, then an admin fee of 5% will be charged if you decide to cancel the order after 24 hours of placing it.

  • Do not send us sim cards as we will not be held responsible for them.

  • Send the handset & battery only.

  • Send the phone by Special Delivery (registered post) where it is covered by insurance. We will not be held responsible for any phone sent by standard Royal Mail or recorded delivery which may have missing bits or been tampered with or damaged on it's way to us.

  • Remote unlocking is a new service we provide, and sometimes it may not work. If it doesn't work then the phone to be unlocked must be sent to us to unlock as the alternative, and the extra charge if needed be paid, as we do not refund this service.

  • Always send details of IMEI, name address, unlock required and payment method with amount paid and price and date paid.

9. Part-Exchange

  • We part exchange phones and expect the customers phone and payment to be sent to us first and after inspection we will send the required phone out.

  • We will only part-exchange if full proof of address is sent and proof of purchase and that the phone is in the condition as stated.

  • The offer we give you is only valid for 2 weeks.

  • We have the right to refuse the exchange on receiving the phone, if we are not entirely happy with the handset, condition of proofs, or if we suspect fraudulent activity.

  • Send the phone by Special Delivery (registered post) where it is covered by insurance. We will not be held responsible for any phone sent by standard Royal Mail or recorded delivery which may have missing bits or been tampered with or damaged on it's way to us.

  • We expect the phone to be sent with box, manual and charger.

12. Web Site Accuracy

  • As the world of telecommunications is being continuously updated almost daily, its hard to keep all of our information up to date at all times however hard we try. As we do update our site regularly regarding each new development, we should be accurate in the information we provide you, but we cannot be held responsible for any displayed information that has since changed after our date of publish.

12.Privacy Policy

  • Phatphones may pass on customers contact details to relevant outside parties or organisations when they have opted in to our occasional newsletter.

  • Phatphones may use a customers contact details if they have previously purchased, or made an enquiry to send an occasional offer by email. We would not however pass these to any outside organisation.

  • However we hold the right to pass on any information to the relevant authorities at their request.

This does not affect your statutory rights which cannot be excluded or restricted by law.

13.Fraud Prevention

  • We may require documents of proof of name and address sent to us by email, fax or post before sending any of our orders, particularly for larger transactions, we will notify you by email if this is the case.

  • If your order exceeds £250 we will surely contact you for such details.

  • Your IP address is noted when you make a purchase.

  • Phatphones.com takes credit card fraud seriously and will prosecute to the highest degree if such action is made on this site.

  • We hold the right to decline any order we suspect to be fraudulent.

  • Sometimes we may choose not to process an order, due to lack of proofs or correspondence when further security information is required. Such orders will not be processed and the amount not debited from the card used to make the purchase.

14. Disclaimer

  • The use of any product on our site is solely the responsibility of the intended user we will not be held responsible for an injury, accident, misuse or illness that may occur from any product bought from us.

  • Any defects would be dealt with by the manufacturers and we are not to be held responsible for any item causing any damage or illness or accident. Any product bought from us which is supposedly defective will be sent to the manufacturer for analysis. As we do not produce any items ourselves but are distributors we would not be responsible to deal with defective items after 7 days of receiving an item.

  • Our products are sold mainly through word of mouth and we will not be liable for any product not meeting to the requirement of the user.

  • All our products are not tested by us. Any manufacturing defect would need to be taken up with them.

  • Any side effects experienced from a product on our site will be the responsibility of the user. We will try to give accurate descriptions as best possible where required but further information can be obtained from emailing us or the manufacturer.
